OnlyFans fined over user age-check information failings

The company, which requires users to be at least 18 years old, utilizes facial age estimation technology to assess the age of potential users based on selfies they submit. Initially, OnlyFans claimed that anyone appearing to be under the age of 23 would be flagged and required to provide additional identification. However, it was later revealed that the technology was actually set to identify users who were 20 years old or younger. This discrepancy led Ofcom, the regulatory body overseeing such platforms, to determine that Fenix, the parent company of OnlyFans, had failed to meet its legal obligations to provide accurate information. Suzanne Cater, Ofcom's Enforcement Director, emphasized the importance of accurate information for regulatory purposes, stating, 'Receiving accurate and complete information is fundamental for Ofcom to do its job as a regulator and to understand and monitor how platforms are operating. ' The fine, which was reduced by 30% because Fenix accepted responsibility, will be directed to HM Treasury. In response to the situation, OnlyFans acknowledged the importance of providing timely and accurate information to Ofcom and expressed relief at the conclusion of the investigation into their age verification measures. Yoti, the company responsible for the age estimation technology, clarified that the decision to set the age threshold at 20 instead of 23 was made by Fenix, not by Yoti. Ofcom began its inquiries into OnlyFans in June 2022 and continued into June 2023, utilizing powers that existed before the implementation of the Online Safety Act (OSA). This new law, which is set to take full effect this year, imposes stricter responsibilities on technology companies to protect users, especially young individuals, from harmful online content. Critics of the OSA argue that it does not go far enough in ensuring safety, describing it as 'uneven. ' The act emphasizes the need for more stringent age assurance measures, and platforms like OnlyFans have been informed that they must comply with these new requirements. While OnlyFans is primarily recognized for its adult content, it also features content from musicians and celebrities.
