She has accused him of sexual assault, battery, and gender violence. The lawsuit, which was filed in Los Angeles, outlines their relationship, describing how Brianna initially thought Andrew was a 'dream come true. ' However, she claims that he soon became emotionally and physically abusive. The lawsuit details a violent incident that allegedly occurred on March 11 at The Beverly Hills Hotel, where Brianna claims she was assaulted and threatened by Andrew. In response to these allegations, Andrew's attorney has dismissed the claims, labeling the lawsuit as a 'blatant cash grab' and accusing Brianna of making these accusations for 'money and attention. ' Joseph McBride, Andrew's lawyer, stated that they are prepared to defend him vigorously in court, asserting that the truth will reveal the baseless nature of the claims. He also criticized Brianna's attorney, Tony Buzbee, who is representing multiple victims alleging sexual assault against Sean 'Diddy' Combs, calling him a 'lowlife bottom feeder. ' This lawsuit comes in the wake of Andrew and his brother Tristan Tate's arrest in 2022 on charges of forming a criminal organization, with Andrew also facing rape charges in another country. Both brothers have been accused of sexual assault in the US and the UK, but they have not been convicted of any crimes. The lawsuit describes a pattern of alleged manipulation and grooming that began when Brianna first met Andrew in Romania during the summer of 2024, where she had traveled for a modeling job. According to the lawsuit, Andrew told Brianna that he would take care of her and that she would not have to work if they were in a relationship. Initially, he presented himself as charming, but Brianna alleges that his behavior quickly turned demeaning and threatening. She claims that he referred to her as his 'property' and subjected her to verbal abuse, calling her an 'idiot' and other derogatory names. The lawsuit states, 'Tate began verbally degrading [the] Plaintiff as he routinely did - but this time it was much worse, more aggressive, and more violent. ' Brianna alleges that he struck her in the face and head, and she cried out for him to stop, claiming that at one point the pressure on her neck nearly caused her to lose consciousness. The lawsuit states that Andrew repeatedly told her that if she ever crossed him, he would kill her. After the incident, Brianna acted as though nothing was wrong in hopes of safely leaving the hotel the next morning. She later sought medical attention, where a physician diagnosed her with 'post-concussion syndrome. ' Andrew allegedly sent Brianna a message saying, 'If you ever betray me you will regret it. ' The lawsuit indicates that she waited until he left the country to report the assault to law enforcement. In addition to seeking punitive damages, Brianna is requesting a restraining order and hopes that this legal action will prevent Andrew from continuing his pattern of abusing women.
