On the other hand, James Lewis from the Center for Strategic and International Studies believes that the law was carefully crafted to withstand legal challenges. He stated that the case against TikTok is robust, and the key issue is whether the court will accept that requiring the company to divest does not infringe upon free speech rights. Lewis also noted that courts typically defer to the president on matters of national security. Regardless of the outcome of the appeals court ruling, experts agree that this case could extend for several months, if not longer. Mike Proulx, vice president and research director at Forrester, added that the stakes are high, and the case is likely to progress to the Supreme Court, the highest judicial authority in the United States.
