The Department of Justice has stated that the firings were based on guidance from the Office of Personnel Management, which is responsible for overseeing the federal civil service. The OPM has recently gained attention due to President Trump's efforts to decrease the size of the federal workforce. During the court hearing in San Francisco, Judge Alsup challenged the arguments presented by the Department of Justice lawyer, referencing evidence that included termination letters indicating that the firings were executed under the instructions of the OPM. Judge Alsup remarked, 'That should not have been done in our country,' emphasizing that the actions taken were a way to avoid following the law. Danielle Leonard, a lawyer representing a coalition of government employee unions, pointed out that probationary employees were specifically targeted because they did not have the right to appeal their dismissals. Judge Alsup also expressed his disappointment over the firing of a government worker in Albuquerque, New Mexico, who had received outstanding performance evaluations but was still terminated for alleged performance issues. He stated, 'It is a sad day when our government would fire a good employee and say it's for performance when they know good and well that's a lie. ' Following Judge Alsup's ruling, a similar decision was made by District Judge James Bredar in Baltimore, Maryland, who concurred that the Trump administration had violated regulations and raised doubts about the legitimacy of the claims that the workers were dismissed for unsatisfactory performance. In response to the initial ruling, White House press secretary Karoline Leavitt accused Judge Alsup of attempting to unlawfully seize the hiring and firing powers from the executive branch. She asserted that this authority belongs to the president and that individual district court judges should not misuse their power to obstruct the president's agenda. Leavitt added, 'The Trump administration will immediately fight back against this absurd and unconstitutional order. ' Although Elon Musk's name was not brought up during the California hearing, he has been assigned by President Trump to assist in reducing the federal workforce through a newly established group called the Department of Government Efficiency, or Doge. Luz Fuller, who leads a local branch of the American Federation of Government Employees, noted that Musk was on everyone's mind during the hearing. The White House has confirmed that Musk is the head of this agency, even though Trump referred to him as such during his Congressional address last week.
