Judge Ginsberg, however, pointed out that the law does not target TikTok alone but rather a group of companies that are controlled by foreign adversaries. This distinction is crucial as it highlights the broader implications of the law beyond just TikTok. Additionally, creators who rely on TikTok for their work expressed their concerns about the law's impact on their rights. Jeffrey Fisher, representing these creators, argued that the law would hinder their constitutional right to collaborate with the platform of their choice, which, under its current ownership, is TikTok. The Department of Justice (DoJ) is also presenting its case in court, citing data security concerns and the potential for TikTok to be used by the Chinese government to surveil American citizens. Advocates for free speech rights, protected by the First Amendment of the US Constitution, have voiced their opposition to the divest-or-ban law, suggesting that it could set a dangerous precedent for authoritarian regimes worldwide. Xiangnong Wang, a staff attorney at Columbia University's Knight First Amendment Institute, warned that if this law is upheld, it could embolden repressive governments to impose similar restrictions on their citizens' access to information and media from abroad. On the other hand, James Lewis from the Center for Strategic and International Studies believes that the law was carefully crafted to withstand legal challenges. He stated that the case against TikTok is robust, and the key issue is whether the court will accept that requiring the company to divest does not infringe upon free speech rights. Lewis also noted that courts typically defer to the president on matters of national security. Regardless of the outcome of the appeals court ruling, experts agree that this case could extend for several months, if not longer. Mike Proulx, vice president and research director at Forrester, added that the stakes are high, and the case is likely to progress to the Supreme Court, the highest judicial authority in the United States.
