The committee is concerned that consumers might be misled into thinking there is a partnership between the US Olympic and Paralympic Committee and Prime when, in fact, there is none. They previously sent a cease and desist letter to Prime, but the drink brand continued to promote the product with the Olympic branding. There has been criticism directed at Prime for marketing their drinks to a younger audience, especially since some schools have raised concerns about the product. Prime offers two types of drinks: one that contains caffeine and another that is caffeine-free, which is marketed for hydration. Earlier this month, Chuck Schumer, the US Senate Majority Leader, expressed concerns about the high caffeine content in Prime's energy drink. In response to these concerns, Prime stated that they comply with all regulatory requirements in the countries where they operate. When Prime was launched in the UK, it generated a lot of excitement, leading some stores to limit the number of bottles customers could purchase.
