India's Supreme Court is facing a serious issue after a judge in Andhra Pradesh used fake legal orders created by artificial intelligence to decide a property dispute. The Supreme Court in Delhi has now put a hold on the lower court's decision and is looking into the matter closely. The top court said that using AI-generated fake judgments is a big concern because it affects the honesty and trust people have in the legal system. The court called this an 'institutional concern' and said that fake AI judgments can damage the process of making fair decisions.
The problem began in August last year when a junior judge in Vijaywada city had to decide a case about who owned a piece of property. The court had asked an official to check the property and write a report. Some people in the case did not agree with the report and objected. The judge did not accept their objection and used four past legal cases to support her decision. Later, it was discovered that all four cases were not real and had been created by an AI tool. AI programs can be helpful, but sometimes they make up information that sounds real but is actually false. The people who lost the case went to the state's high court and pointed out that the judge used fake cases. The high court agreed that the cases were fake but said the judge made an honest mistake because it was her first time using AI. The high court still agreed with the lower court's decision, saying that as long as the judge used the right legal ideas, the fake cases did not matter.
However, the people in the case were not satisfied and took the matter to the Supreme Court. The Supreme Court was much stricter and said that using AI-generated fake judgments is not just a simple mistake but a serious problem. The court said it would look at the case in detail and asked for reports from top legal officials. The court also said that judges and lawyers should use their own intelligence and not just trust AI tools. This is not the first time AI has caused problems in courts. In other countries like the US and the UK, judges and lawyers have also used fake AI-generated information by mistake. India's Supreme Court has already published guidelines for using AI in the legal system and says that human checks are very important. The court wants to make sure that AI is used carefully and that the legal system stays honest and trustworthy.
